Acceptance

These Terms & Conditions (“Terms”) govern your use of joshuatawney.com (the “Site”), operated by Joshua M. Tawney (“I,” “me,” or “my”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Site content and ownership

Unless otherwise credited or stated, the Site’s text, design, layout, editorial presentation, graphics, diagrams, photographs, videos, downloadable materials, and other original content are owned by Joshua M. Tawney and are protected by copyright and other applicable laws. Credited third-party material remains the property of its respective owner.

Names, logos, and trademarks shown in portfolio work may belong to clients, collaborators, or other third parties and are used to describe that work.

Permitted use

You may view the Site for personal, educational, editorial, and other lawful reference; link to public pages; and make brief quotations with clear attribution and a link to the relevant page. These limited permissions do not transfer ownership.

Unless a specific notice permits it, you may not copy or repost substantial content, remove attribution, sell or paywall Site material, create derivative works, scrape the Site at scale, or use its content for commercial products, services, promotion, training datasets, or competing publications without prior written permission.

Project-specific permissions control

Some pages or downloads include their own copyright, license, or use-and-permissions notice. That specific notice controls for that material if it differs from these general Terms. For example, “How to Start a Small-Town Publication” has a project-specific permission notice allowing certain free sharing and community use while reserving commercial and adaptation rights.

Fair use and other lawful exceptions remain unaffected.

Third-party materials

The Site may include client work, collaborator contributions, photographs, artwork, fonts, maps, links, embeds, or services owned or operated by others. Nothing in these Terms grants permission to use third-party material. Your use of an external site or service is governed by that provider’s terms and policies.

Portfolio and informational purpose

The Site presents portfolio, editorial, educational, and general informational material. It is not legal, financial, architectural, engineering, medical, or other professional advice. Viewing the Site or contacting me does not by itself create a client, consultant, fiduciary, or professional relationship.

Any project-specific decisions should be based on appropriate independent professional advice and current requirements.

Interactive features and external services

Interactive guides and maps are provided for general use and may rely on third-party services. Do not submit private, confidential, or sensitive information. Availability, map results, and external data may be incomplete, delayed, or inaccurate, and third-party services may change or stop operating without notice.

Your use of the Site must be lawful and must not interfere with its security, operation, or other visitors.

Availability, accuracy, and warranties

I aim to keep the Site accurate and useful, but do not guarantee that every item is complete, current, error-free, uninterrupted, or suitable for a particular purpose. To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied.

Limitation of liability

To the maximum extent permitted by law, Joshua M. Tawney will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunity, or goodwill arising from or related to the Site, its content, downloads, external links, or third-party services.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be handled in a court with lawful jurisdiction in New York, unless applicable law requires otherwise.
